This article focuses on the qualifications for the appointment of EACC commissioners in Kenya. The Ethics and Anti-Corruption Commission (EACC) is a public body established under Section 3 (1) of the Ethics and Anti-Corruption Commission Act, 2011.
The commission consists of a chairperson and 4 other members appointed according to the provisions of the constitution and Section 4 of the EACC Act. It also has a secretariat headed by the Secretary/ Chief Executive Officer (CEO) of the commission.
EACC’s mandate is to combat and prevent corruption, economic crime and unethical conduct in Kenya through law enforcement, public education, promotion of standards and practices of integrity, ethics and anti-corruption.
Qualifications for Appointment of EACC Commissioners
(i). Qualifications for the Chairperson
- Meet the requirements of Chapter 6 of the constitution.
- Hold a degree from a university recognised in Kenya.
- Have knowledge and experience of not less than 15 years in ethics and governance, law, public administration, leadership, economics, social studies, audit, accounting, fraud investigation, public relations and religious studies.
- Has a distinguished career in the respective field.
(ii). Qualifications for other Commissioners
- Meet the requirements of Chapter 6 of the constitution.
- Hold a degree from a university recognised in Kenya.
- Have knowledge and experience of not less than 15 years in ethics and governance, law, public administration, leadership, economics, social studies, audit, accounting, fraud investigation, religious studies & philosophy or public relations and media.
A person shall not be qualified for appointment as a chairperson or a member if the person;
- Is a member of a governing body of a political party.
- Is an undischarged bankrupt.
- Has been convicted of a felony.
- Has been removed from public office for contravening the provision of the constitution or any other law.
Terms of Office
The chairperson and members of the commission shall be appointed for a single term of 6 years and are not eligible for re-appointment. They shall serve on a part-time basis.
